Licence

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this licence your company or partnership must nominate an employee who is licensed as an individual to conduct the work you are applying for. This nominee is responsible for ensuring all work conducted by employees of your company or partnership meet all relevant standards and they must be named on your application. You will also be required to provide evidence that your company or partnership exists, the information required by the Agency differs depending on your business structure.

If you are applying as a company you must provide an extract of the company history that is displayed on the Australian Securities and Investments Commission (ASIC). If you are applying as a partnership you must show evidence of the partnership and state the name of each partner. If one of the partners is a company you must provide its Australian Company Number (ACN).

Prerequisites

Ongoing requirements

A corporation that is the licensee must give the registrar written notice when:

  • The corporation becomes the subject of a winding-up order; or
  • A controller or administrator is appointed for the corporation.

For a partnership that is licensed in a construction occupation or class, the licensee must give the registrar written notice of when a partner?s licence in the same occupation or class is suspended or cancelled.

Notice must also be given when:

  • The licensee does not have the required nominee or nominees for the construction occupation or occupation class of the licence; or
  • The licensee or a director or partner of the licensee is found guilty, whether in the ACT or anywhere else, of an offence that involves fraud, dishonesty or violence that is punishable by imprisonment for at least one year.
