Commercial Television and Radio Broadcasting Service Licences - Australian Government

Description

You will require one or more of these licences if you intend to provide commercial radio and / or television broadcasting services, including broadcasting via land, satellite, digital or cable.

Commercial broadcasting services:

  • provide programs that are intended to appeal to the public (for example, entertainment, sports, news)
  • provide programs that can be received using commonly available equipment (for example, televisions and radios)
  • are free to the public
  • are usually funded by advertising revenue and are operated for profit or as part of a profit-making enterprise.

Please note that an international broadcasting service licence requires special permission. Other transitional conditions may apply, including content of the service and the carriage of the signal.

Regional commercial radio broadcasting operations must broadcast a specific amount of content that is considered material of local significance. The amount of time that must be spent broadcasting material of local significance depends on the location of the radio broadcast.

Eligibility requirements

To be eligible for this licence you must:

  • be a company formed in Australia with a share capital
  • satisfy the Agency that your company is a suitable applicant and does not pose a risk of committing an offence under the Act, civil penalties or licence breaches
  • submit the application in the approved form.

Ownership and control provisions apply regarding cross-media ownership and numerical market limits for television and radio and foreign ownership and national audience reach for television and related directorship limits.
