Water Supply Work and Use Approval - New South Wales

Service summary

You may require this approval if you intend to take water or construct and use a water supply work.

Every owner or occupier of a landholding has basic landholder rights. These rights allow you to take water from a water source, and to construct certain water supply works, for the purposes of domestic consumption and stock watering. If you intend to take water for any other purpose, or to construct a dam or water bore, you will require this approval.

There are two main categories of approvals: water supply work approvals and water use approvals.

  • A water supply work approval authorises you to construct and use a water supply work at a specified location. Approvals may be granted to construct and operate water supply works such as bores, spearpoints or wells and to use water for a particular purpose, such as irrigation.
  • A water use approval authorises you to use water for a particular purpose, such as irrigation, at a particular location. It can also authorise you to use water taken from a water source outside NSW.

Each approval includes conditions to minimise adverse impacts, and cannot be traded to another property or location.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Exemptions

Activities that require approval under environmental planning legislation do not require water use approval. Other exemptions may also apply.

Eligibility requirements

To be eligible for this approval you must:

  • Submit a completed application form;
  • Demonstrate that you have secure tenure over the land where the work is to be located or where the water is to be used;
  • Provide details of the use or works to be conducted; and
  • Pay the prescribed fee.
