A group of five or more people may form an incorporated association in New South Wales by registering with NSW Fair Trading. These incorporated associations should be small-scale, non-profit and non-commercial in nature.

Eligibility requirements

To be eligible for incorporation, you must:

  • Have no fewer than 5 members and a committee consisting of at least three members;
  • Appoint a Public Officer of at least 18 years of age residing in New South Wales; and
  • Pay required fees.

Eligibility is subject to various regulations in respect to trading, buying and selling of shares, stock and property for financial gain of the association and its members.

Duration

Incorporation continues until formally cancelled or wound up.
