Approval to Construct an Animal Display Establishment - New South Wales

Description

You will need this approval if you intend to construct an animal display establishment. This approval allows you to establish, operate, extend or alter a zoo, marine park, aquarium or other establishment where animals are exhibited.

You may be exempt from this approval if you intend to exhibit certain types of fish or wildlife only in either:

  • the course of their display for sale
  • a competition, race, or rodeo
  • an agricultural demonstration, show or parade
  • an authorised scientific experiment
  • the operation of a fish farm or similar establishment
  • a meeting of an organisation dedicated to the keeping of those animals
  • a school 'show-and-tell' activity.

You will need to meet additional requirements if you intend to construct or operate an establishment where dolphins or whales are exhibited.

Eligibility requirements

To be eligible for this approval, you must:

  • comply with the relevant standards for the operation of animal display establishments, including provisions contained in animal welfare legislation
  • obtain permission to display any animals for which a permit is required
  • obtain appropriate public risk insurance
  • display the approval, once obtained, at the premises at which your establishment is located
  • implement measures to ensure veterinary drugs kept at your establishment are accessed and administered only by veterinary practitioners, and that veterinary equipment is safely disposed of
  • develop and implement a plan to educate visitors to your establishment with regard to the conservation of animals
  • maintain appropriate records of animals kept at your establishment
  • notify the agency in the event of the escape of any animal, an injury caused by an animal to a member of the public, or the widespread outbreak of any serious disease amongst the animals at your establishment
  • maintain a supply of anti-venom and an emergency treatment plan for any venomous animals at your establishment
  • house and exhibit animals at your establishment in a way that ensures the safety of visitors, without tethering animals for any purpose other than veterinary treatment or grooming
  • employ an adequate number of trained and competent staff.

Applications for renewal of existing approvals must be lodged in May of each year.
