Food Business Notification - New South Wales

Service summary

All food businesses in New South Wales must either hold a current food licence or notify the authority of their food activity details. Food businesses that are required to be licensed are:

  • businesses that provide food service to vulnerable populations
  • plant product businesses
  • businesses that handle or process meat
  • businesses that handle or process seafood or shellfish
  • dairy producers, factories and vendors
  • businesses that produce or process eggs and egg related products.

If your business is not in one of these categories you do not require a specific licence to operate in NSW, however, you do still need to provide the authority with details of your business and its activities. Examples of businesses that have to provide notification are:

  • retail food outlets
  • businesses whose primary purpose is not the sale of food (for example. chemists, cinemas, corner stores, petrol stations or sporting facilities)
  • food stall holders at special events
  • mobile food outlets
  • school canteens
  • some child-care facilities
  • some food manufacturers
  • food transport, storage or wholesale businesses
  • importers and exporters of food or food ingredients.

Please be aware that in some circumstances you may also require approval from you council (for example, for mobile food outlets and food stall holders at special events). 

Notification of food businesses allows the Authority to contact your business with critical information regarding food recalls and food-borne illness outbreaks.

Please note that:

  • all food businesses must comply with the relevant food standards and food labelling requirements
  • certain hospitality and retail food service sector businesses must also designate a food safety supervisor
  • you may not be required to notify the authority if you are serving food as part of a not-for-profit fundraising event.
