Mineral Claim - New South Wales

Service summary

You will require this claim if you intend to become the owner of minerals within a designated area of a mineral claims district.

A mineral claims district is an area designated by the Agency. For example, the Lightening Ridge Mineral Claims District. Claims may be granted over any mineral, except coal, and are restricted to a maximum of two hectares in area. A claim will not be approved if it overlaps:

  • another person's prospecting area
  • an area designated by the Agency as a reserve
  • an area subject to an assessment lease, mining lease, mineral claim or exploration licence for the same minerals.

The claim may be granted over both Crown or private land, and gives you the exclusive right to prospect and mine for the mineral or minerals specified in your claim.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this claim, you must

  • be 18 years of age or over
  • attend a mining safety course
  • specify the mineral you intend to claim
  • mark the required area
  • create a plan of the area
  • notify any affected landholders of your claim
  • attend an environmental awareness course.

Up to 5 years.

Expiry

Anniversary of date of issue (maximum five years).
