Registration of a Pre-Paid Funeral Fund - New South Wales

You will need to be registered if you intend to operate a pre-paid funeral fund. This includes offering consumers goods and services to be supplied for their funeral, and allowing the costs associated with those funeral services to be paid for in advance.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this registration, you must:

  • Provide a statement of agreement between the corporation or trustees and individuals who have agreed to supply services for the purpose of the licence;
  • Provide bond in the form of a bank guarantee once amount has been determined by Department;
  • Provide statements that the applicant and any directors, trustees of officers have no prior convictions of offences in relation to dishonesty or fraud or any other offence, and whether any have been declared bankrupt or disqualified from practising any profession in relation to business;
  • Provide statement of funds incomes and expenditures for next 3 financial years;
  • Provide 2 character references for each director, trustee or officer; and
  • Pay any required fees.


Valid unless cancelled or wound up.

You will be required to submit a copy of the bond or arrangement when applying for registration as the trustee or trustees of trust funds. This is required as your business will be receiving money in advance.
