Surveyors Act 2003 - Queensland

Service summary

The purpose of the act is to:

  • protect the public by ensuring surveys are carried out by registrants in a professional and competent way; and
  • uphold the standards of practice within the profession; and
  • maintain public confidence in the profession.

The Act:

  • establishes the basis for registration as a surveyor
  • requires surveyors who perform cadastral surveys to be registered surveyors with a cadastral endorsement
  • requires surveyors who conduct a business that provides cadastral surveying services to hold a consulting endorsement, which includes a requirement to hold professional indemnity insurance
  • establishes a complaints and disciplinary process in relation to the professional conduct of registered persons.

The Surveyors Board is formed under the Act to implement registration and disciplinary functions.

Compliance Mechanisms and Penalties:

Persons may make a written complaint to the Board about the conduct of registered persons.

The Board has power to appoint investigators to investigate possible professional misconduct under the Act. After considering the investigator's report, a professional conduct review panel of the Board may impose fines or require the surveyor to correct a survey or undergo further training, or if the situation requires it, refer the matter to Queensland Civil Administration Tribunal (QCAT). QCAT may impose more severe penalties, including reprimands, fines, orders for correction of defective work and suspension or cancellation of registration or endorsements.

Review or Appeal Mechanisms:

The Act requires information notices to be given when particular decisions are made. The information notice must include advice that the decision can be reviewed by QCAT.

Decisions of QCAT may be appealed to the appeal tribunal of QCAT. An application for leave to appeal must be filled in the registry within 28 days.
