Object or Purpose of this legislative Instrument:
To provide for the protection of the public by regulating the use of listening devices and to prohibit the unlawful entry of dwelling houses.
Scope of this legislative Instrument:
The Act prohibits the use of listening devices and the unlawful entry of dwellings. The Act also prohibits the publication or communication of private conversations where a listening device has been used, except in limited circumstances.
An obligation defined in law. A business must comply with relevant services.
Definition of terms
- Listening device
any instrument, apparatus, equipment or device capable of being used to overhear, record, monitor or listen to a private conversation simultaneously with its taking place.
It is recommended that a legal practitioner be consulted about the application of this Act.
Compliance Mechanisms and Penalties:
Fines or imprisonment may be imposed by the court for breaches of the Act.
Review or Appeal Mechanisms:
An appeal may be made against a conviction in accordance with the law and relevant court rules.
