Fire protection - Individual contractor or nominee supervisor or fire occupational licence - Queensland

Service summary

As a contractor, you require the Fire protection contractor licence to carry out, supervise or certify fire protection work (under contract with a builder or consumer), within the scope of work definition for one of the classes of:

  • fire detection, alarm & warning systems
  • passive fire protection (fire and smoke walls and ceilings)
  • passive fire protection (fire collars, penetrations and joint sealing)
  • passive fire protection (fire doors and shutters)
  • portable fire equipment and hose reels (hose reels down stream of stop cock only)
  • fire hydrants and hose reels
  • fire pumps
  • sprinkler and suppression systems, reticulated water based
  • special hazard suppressions systems
  • emergency lighting
  • emergency procedures
  • fire safety professional.

Being a nominee supervisor licensee entitles you to supervise but not carry out building work within the scope of work prescribed for the particular licence class.

Please Note: Unlicensed contractors are required to state in their advertisements for building work the value of work they are entitled to carry out without a licence. Some examples of statements that comply with these requirements include:

  • cannot perform building work valued in excess of $3,300
  • cannot perform building work valued at more than $3,300
  • only work valued at $3,300 or less.

A penalty applies for an unlicensed contractor who fails to make such a statement in an advertisement.

If an advertisement by an unlicensed person does not refer to any sort of building work, no statement is required.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Definition of terms

Building contractor

a person or company who carries on a business that consists of or includes carrying out building work, and includes a sub contractor who carries out building work for a building contractor.

Building work

But does not include work of a kind excluded by regulation from the ambit of this definition.

  1. the erection or construction of a building
  2. the renovation, alteration, extension, improvement or repair of a building
  3. the provision of lighting, heating, ventilation, air conditioning, water supply, sewerage or drainage in connection with a building
  4. any site work (including the construction of retaining structures) related to work of a kind referred to above
  5. the preparation of plans or specifications for the performance of building work
  6. a contract administration carried out by a person in relation to the construction of a building designed by the person
  7. fire protection work
  8. carrying out site testing and classification in preparation for the erection or construction of a building on the site
  9. carrying out a completed building inspection
  10. the inspection or investigation of a building, and the provision of advice or a report for the following
    1. termite management systems for the building
    2. termite infestation in the building.
Company

means any body corporate.

Exempt building work
  1. anything mentioned in paragraphs (a) to (f) of the definition "Building Work" if it is for a farm building;
  2. work of a value of less than $3,300, unless
    1. subject to paragraph (ad), the work is within the scope of work of a fire protection licence; or
    2. the work is within the scope of work of a licence provided for in schedule 2, part 11, 14, 18, 19, 33, 48 or 52; or
    3. the work is within the scope of work of another licence provided for in schedule 2, and is carried out by a licensee as part of a contract for building work of which the value is $3,300 or more
  3. giving of free advice by an organisation the membership of which is drawn wholly or predominantly from the building industry
  4. work performed by an architect in the architect's professional practice
  5. work performed by an engineer in the engineer's professional practice
  6. survey work performed by a licensed surveyor in the surveyor's professional practice
  7. work performed by the Commonwealth or an instrumentality or agency of the State but not work performed for the Commonwealth or an instrumentality or agency by an independent contractor
  8. work performed by the State or an instrumentality or agency of the State but not work performed for the State or an instrumentality or agency by an independent contractor;
  9. work performed by a local government but not work performed for a local government by an independent contractor
  10. work performed by a charitable or community organisation for its own use, if the Authority gives the organisation written notice the work can be excluded from the definition "building work", given the qualifications and experience of persons who will supervise the work
  11. construction, extension, repair or replacement of a water reticulation system, sewerage system or stormwater drain, outside the boundaries of private property
  12. construction, maintenance or repair of a road under the Land Act 1994
  13. construction, maintenance or repair of a bridge other than a bridge on land in private ownership
  14. construction, maintenance or repair of railway tracks, signals or associated structures unless the structures are buildings for residential purposes, or are storage or service facilities
  15. construction, maintenance or repair of airport runways, taxiways and aprons
  16. construction, maintenance or repair of harbours, wharfs and other maritime structures unless the structures are buildings for residential purposes, or are storage or service facilities)
  17. electrical work under the Electrical Safety Act 2002
  18. installation or general repair, by a licensed electrical mechanic, of a fire detection system, alarm system, or emergency warning and communication system for a building;
  19. construction, maintenance or repair of a dam
  20. construction, maintenance or repair of communications installations performed for a public company or other public body engaged in radio or television broadcasting or in some other form of communications business or undertaking
  21. construction, maintenance or repair of a sign that does not have any supporting structure. Example: a sign that consists of only a flat sheet of acrylic resin, fabric, metal or wood
  22. construction, maintenance and repair of a supporting structure for a sign if
    1. the value of building work for the supporting structure is less than $5,000
    2. the top of the sign or supporting structure, whichever is higher, is less than 3m above the surface immediately below the sign or structure, including for example, the ground, or a road or path on which individuals may travel, weather in a vehicle, while walking or in any other way
  23. erection of scaffolding
  24. installation of manufacturing equipment or equipment for hoisting, conveying or transporting materials or products (including primary produce), but excluding the installation of fixed structures providing shelter for the equipment
  25. construction work in mining
  26. hanging of curtains or blinds, or laying of carpets or vinyl
  27. work consisting or monumental masonry, sculpture, or the erection or construction of statues, fountains or other works of art (other than work affecting the structure of a building)
  28. work consisting of earthmoving and excavating
  29. work, other than work within the scope of work of an occupational licence, performed personally by the owner of the land on which the work is performed if
    1. the value of work is less than $6,600; or
    2. under the Building Act 1975, chapter 2, the work is, for the Integrated Planning Act 1997, self assessable development or exempt development
  30. work within the scope of work of a fire protection licence performed personally by the owner of the land on which the work is performed if the value of the work is less than $3,300
  31. certification work performed by a building certifier under the Building Act 1975 in the certifier's professional practice
  32. services performed by a registered valuer under the Valuers Registration Act 1992 in the valuers professional practice
  33. laying of asphalt or bitumen
  34. work done under the Workplace Health And Safety Regulation 1997, part 11, division 3 to comply with the asbestos management code
  35. an inspection, investigation or report for assessment of an insurance claim
  36. work of the type usually performed by a locksmith, whether performed by a locksmith or another person
  37. work consisting of the preparation for, or installation of, insulation for acoustic or thermal control
  38. preparation of plans or specifications for building work for the interior design of a building if the work does not relate to a part of the building that is load bearing or a structural member
  39. contract administration for the interior design of any building
  40. assessment of the energy efficiency of a building.
Nominee supervisor

in relation to a company, means an officer or employee of the company, nominated by the company to have the general supervision of building work carried out under the licence.

Eligibility requirements


You must provide evidence in the following areas:

  • technical qualifications;
  • managerial qualifications;
  • experience requirements; and
  • financial requirements.

As an applicant for a nominee supervisor licence you are not required to meet the financial requirements for licensing.

As an applicant for a Fire Occupational Licence, you will only be required to meet the technical qualification requirements.

Transferability

This licence cannot be transferred.

Duration

This licence will remain in effect for 12 months from date of issue. Renewal notices are issued annually.

Fees

Fees prescribed in the QBCC Regulation and reflected in QBCC's website information and the relevant application and renewal forms.  Contractor fees vary according to the contractor's turnover.
