Why the Support is Provided?

NRM Programs is responsible for administering the 13 river improvement trusts constituted under the River Improvement Trust Act 1940.

The River Improvement Trust Act 1940 provides the framework for the establishment and operation of a river improvement trust (a trust). Within its river improvement area, a trusts functions are principally to protect and improve rivers, repair and prevent damage to rivers and prevent or mitigate flooding of land by riverine flood events.

A river improvement trust area may comprise all or part of one or more local government areas and the membership of a trust is representative of the relevant local government areas. Included in the membership of a trust are persons appointed by the Governor in Council.

As statutory bodies, trusts have statutory obligations under various public sector legislation; for example, the Financial Accountability Act 2009 and the Statutory Bodies Financial Arrangements Act 1982. As well, a river improvement trust may be required to implement relevant government policies.

What Support is Provided?

NRM Programs provides information about the statutory requirements, including procedural and reporting requirements and the roles and responsibilities of river improvement trusts as determined by the enabling legislation (i.e. the River Improvement Trust Act 1940) and other legislation.

Individuals may draw on the expertise, knowledge and information held by a trust in all aspects of the river/s within the relevant trusts jurisdiction. However, not all local government areas are part of a river improvement trust area.

Eligibility requirements

The establishment of a trust is subject to section 3 of the River Improvement Trust Act 1940 which enables a local government to make application to the Minister for the constitution of a river improvement area comprising the relevant local government area or part thereof. A joint application may also be made to the Minister by two or more local governments.

Fees

No establishment fees apply.

However, costs are incurred by a trust in the planning, development and implementation of capital works, restoration (of works damaged or lost due to flooding) and maintenance of works. As well, administration charges may also be incurred by a trust.

To fund these statutory activities, revenue raising powers have been granted to each trust under the River Improvement Trust Act 1940. Trusts can also apply for government grants for project funding; for example under the Natural Disaster Relief and Recovery Arrangements (NDRRA).
