Service summary

The Property Occupations Act 2014 regulates the activities, licensing and conduct of property agents and resident letting agents and their employees. The Act also protects consumers against particular undesirable practices (a claim fund is established to compensate consumers who suffer a loss in their dealings with businesses regulated by this Act).

The Property Occupations Regulation 2014 provides information on limited property agent licences, general provisions about licensees or real estate salesperson, keeping documents, conduct standards, property agents and real estate salespersons, auctioneers, resident letting agents, issuing or renewing licences, fees and refunds.


Authorised investigators, including auditors, monitor the requirements of the Act and investigate complaints.

The Queensland Civil and Administrative Tribunal (QCAT) may exercise disciplinary powers, including cancellation of licences and the imposition of fines and of terms and conditions on licensees. In certain circumstances the Chief Executive may appoint a receiver over trust property.


An appeal against a licensing decision of the Chief Executive may be made to the QCAT Tribunal within 1 month of the notification of the decision.
