Public/Commercial Swimming Pool Registration (Rockhampton) - Queensland

Service summary

Council has recently undertaken a review of its local laws. As a result of this review, from 1 January 2012 Public and Semi-public Swimming Pools will not require an approval as they are prescribed activities under Local Law No 1 (Administration) 2011, specifically Subordinate Local Law No 1.10 (Operation of Public Swimming Pools) 2011.

Please note that the water quality still needs to meet the required minimum standards and not create a public health risk under the Public Health Act 2005. Class 1, 2, 3, 4 buildings will also be required to meet pool fencing requirements under the Building Code of Australia as prescribed in the Building Act 1975 and associated standards.

Definition of terms

Commercial (public)

use of a swimming pool by the owner or occupier or a lessee as a commercial enterprise with a view to profit or gain, available to the general public or any sector of the public on payment of a fee. The term includes the use of swimming pools constructed incidental to motels, hostel, schools, boarding and guesthouses and multi unit residential buildings.

Public pool

A swimming pool that is made available for use to:

  • members of the public or a section of the public on payment of an entrance fee or other charge; or
  • participants in organised swimming or diving competitions or in training for organised swimming or diving competitions; or
  • persons who have a commercial relationship with the owner of the pool, but does not include a swimming pool made available by the body corporate of a group subdivision scheme for use by the owners or occupiers of lots in the scheme or their invitees. Examples:
    • a swimming pool available for use by paying guests in a hotel or motel;
    • a swimming pool available for use by customers or employees of the owner.
Semi public

use of a swimming pool by the owner, lessee or occupiers of the premises upon which the pool is constructed, available to the occupied paying guests, customers or respective invitees, for swimming or bathing, whether on payment of a fee or not. The term includes the use of swimming pools constructed incidental to motels, schools, boarding and guesthouses and multi unit residential buildings.

Additional information

Public or commercial swimming pools are regulated to ensure:

  • swimming pools generally comply with essential standards of health and safety
  • the operation or use of swimming pools does not result in nuisance to adjoining occupiers or others
  • public pools are properly managed and supervised.

Permit conditions

A permit may be granted on conditions council considers appropriate.

The conditions of a permit may require, for example:

  • the operator to test the water daily to ensure that biological contaminants are kept within levels specified in Australian Standards
  • provision of specified equipment for emergency medical treatment and first aid or rescue of persons in difficulty or other aspects of public health and safety
  • erection and display of notices providing information about basic life saving resuscitation and first aid techniques or warning about possible dangers
  • regular testing of the water to ensure that biological contaminants are kept within acceptable levels
  • installation of special equipment for filtering, purifying and recirculating the water
  • provision of dressing rooms and facilities for showering and sanitation.

However the conditions of the permit must be consistent with the conditions of any statutory authorisation or approval for the installation of the swimming pool.

Council may, by local law policy, prescribe conditions that must be imposed in a permit or that will ordinarily be imposed in a permit.

Notice of intention to empty public pool

If the owner of a public pool intends to empty the pool, the owner must give the Local Council at least 24 hours, written notice of intention to empty the pool. The owner must comply with any directions given by an authorised person about when and how the swimming pool is to be emptied.
