A company is entitled to be licensed if: it is not suspended or disqualified from practising or carrying on a trade, business or occupation in Australia; it is not under official management, in receivership or being wound up; it has sufficient financial resources; and together the directors have sufficient business knowledge and experience.
In addition, each director of the company:must be a fit and proper person; must not be suspended or disqualified from practising a trade, business or occupation in Australia; and must not have been within the last 5 years prior to the company's application for a licence, a director of a company wound up for the benefit of creditors - at the time the company was being so wound up or within the period of 6 months preceding the commencement of the winding up.
The Company must demonstrate it has sufficient financial resources, otherwise restrictions may be imposed upon the licence limiting the size of the contracts which may be performed. Share capital requirements also apply.
