Work and Rest Hours Exemption Permit - Victoria

Service summary

You will require this permit if you operate a fatigue-regulated heavy vehicle and intend to operate beyond prescribed maximum work times or under minimum rest times.

A fatigue-regulated heavy vehicle is:

  • a motor vehicle with a gross vehicle mass (GVM) of more than twelve tonnes
  • a combination with a GVM of more than twelve tonnes
  • a bus that is fitted to carry more than twelve people including the driver. 
You may apply for this permit if you are: 
  • an employer of a driver
  • a prime contractor for a driver
  • an operator
  • a self-employed driver.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible you must apply using the approved form and state the following:

  • the period for which the exemption is sought
  • any conditions
  • the name of the heavy vehicle driver
  • proposed maximum work times and minimum rest times.
You will need to pay the prescribed fee and provide any additional information required by the Regulator. You will be required to show that the advanced fatigue management or basic fatigue management limits are not suitable and that the proposed work and rest times are safe.
You must ensure that the driver of the fatigue-regulated heavy vehicle has a copy of the exemption permit in their possession while driving.
