1999 Montreal Convention - Australian Government

You may be required to comply with this Convention if you intend to carry passengers via civil aviation.

The Convention applies where a passenger dies or suffers from an injury which results in death when flying. The Convention substitutes any civil liability of the carrier. The Montreal Convention is an international agreement for the airline industry relating to carriers' liability.
