Datacasting Licence - Australian Government

Description

You will require this licence if you provide a designated datacasting service which is delivered using the broadcasting services bands. Datacasting is the delivery of speciality television or radio content (i.e. not general appeal content), such as speciality text, data, speech, music or other sounds or visual images and other similar types of services. This includes on screen TV guides and other text based services such as program summaries.

A designated datacasting service is any service that is provided by:

  • A commercial television broadcasting licensee;
  • A commercial radio broadcasting licensee; or
  • A national broadcaster.

A datacasting licensee must have an apparatus licence allocated by the Agency under the Radiocommunications Act. Restricted datacasting licences are no longer available

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this licence you must:

  • Be a qualified entity; and
  • Satisfy the Agency that your entity suitable applicant and does not pose a risk of committing an offence under the Act, civil penalties or licence breaches.

A qualified entity means:

  • A company that is formed in Australia or in an external Territory and has share capital;
  • A Commonwealth, State or Territory agency;
  • The Australian Broadcasting Corporation (ABC);
  • The Special Broadcasting Service Corporation (SBS); or
  • Any other body corporate established for a public purpose by a law of the Commonwealth or of a State or Territory.
