Local Practising Certificate - Australian Capital Territory

Description

You will require this certificate if you are an Australian legal practitioner and you intend to engage in legal practise in the Australian Capital Territory. You may apply for one of the three types of practising certificate:

  • Unrestricted
  • Restricted
  • Barrister.

Unrestricted practising certificates are required if you intend to operate as a:

  • Legal practitioner
  • Director of an incorporated legal practice
  • Sole practitioner
  • Principal in a firm
  • Head of a legal area in a government agency.

A restricted practising certificate is required by employee solicitors working in firms, government agencies or incorporated legal practices. If you want to be accepted to the ACT Bar Association then you must apply for a barrister practising certificate.

Licence

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility Requirements

To be eligible for a barrister practising certificate you must:

  • Be a fit and proper person
  • Submit an application form and associated documentation (If you are required to give a statement under section 60 in regards to a show-cause event and you fail to do so the Bar council may refuse to grant you a licence)
  • Hold an Australian citizenship
  • Have the relevant academic qualifications, knowledge, experience and training
  • Not have a criminal record
  • Be admitted to the Australian legal profession
  • Be an Australian citizen
  • Hold a Practice Management Course Certificate or have completed the course within the time frame set by the Australian Capital Territory Law Society.

A current professional indemnity insurance policy is required for applicants requiring an unrestricted practising certificate.

Duration

Remains in force until the end of the financial year unless suspended or cancelled.
