Biobanking Agreement - New South Wales


You will be required to enter into this agreement if you intend to establish a biobank site for the purpose of participation in the Biobanking Scheme. The Scheme enables biodiversity credits to be generated by landowners who commit to enhancing and protecting biodiversity values on their land through a Biobanking Agreement. These credits can then be sold to:

  • Companies seeking to counterbalance (or offset) the impacts of their development activities on biodiversity values; or
  • Entities seeking to invest in conservation outcomes.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility Requirements

To be eligible to enter a Biobanking Agreement, you must:

  • Be the owner, or an owner, of the land upon which you intend to establish a biobank site;
  • Have obtained the written consent of any other owners of that land, or parties with a legal claim to that land; and
  • Submit an expression of interest form.

After you have expressed your interest in establishing a biobank site, you must:

  • Have the land upon which you intend to establish a biobank site assessed by an accredited biobanking assessor;
  • Submit an outline of the management actions you intend to undertake to improve the biodiversity value of your biobank site;
  • Work with the Agency to develop a Biobanking Agreement; and
  • Complete and submit an application form.
