Utility Service Access Order - New South Wales

Description

You will need this order to undertake work on a utility service or a proposed utility service, but do not own the land on which it is located. A utility service is a sewerage, drainage, water, gas, electricity or telephone service.

This order will allow you to access the land for the purposes of carrying out work on or in connection with the utility service.

For the purposes of this order, works include but are not limited to:

  • construction, repair, maintenance, improvement, renewal or adjustment of the utility service
  • connecting or disconnecting the service
  • carrying out inspections to determine whether any work is required
  • making plans for works to be undertaken.

Please be aware that you will need to go to your Local Court to obtain an order.

To be eligible for this order you must be either solely or jointly entitled to the use of a utility service or proposed utility service.

When considering your application, the Court will examine:

  • whether granting the access would cause unreasonable hardship to the person affected by the order.
