Architects Act 2002 - Queensland

Description

The main objects of the Act are to:

  • protect the public by ensuring architectural services of an architect are provided in a professional and competent way
  • maintain public confidence in the standard of services provided by architects and
  • uphold the standards of practice of architects.

The Act provides for:

  • the registration of individuals as architects
  • the monitoring and enforcement of compliance with the Act
  • imposition of obligations on persons about the practice of architecture and
  • establishing the Board of Architects of Queensland.

Compliance Mechanisms and Penalties

The Board may take disciplinary action against architects where complaints are made or breaches of the Act occur. Disciplinary charges are heard by the Queensland Civil and Administrative Tribunal (QCAT).

Penalties include reprimands, fines, deregistration and/or disqualification from registration.

Legal proceedings for offences against the Act are conducted in a Magistrates Court and some sections provide for penalties up to $110,000.

Review or Appeal Mechanisms:

An appeal may be made to the District Court against a decision made by the Queensland Civil and Administrative Tribunal (QCAT).
