Description

Object or Purpose of this legislative Instrument:

  1. Ensuring appropriate standards and levels of accountability for the conduct of general gaming are set and maintained.
  2. Ensuring the public obtains reasonable net benefits from the conduct of general gaming.
  3. Ensuring individuals engaged in conducting general gaming do not derive a personal gain from it.
  4. Ensuring the integrity of general gaming is maintained.
  5. Ensuring public confidence and trust in buying general gaming tickets as a worthwhile way of supporting a persons fundraising activities are maintained.

The Act provides for the issuing of general licenses:

  1. Bingo centre licence
  2. A category 3 gaming licence
  3. A lucky envelope printer licence
  4. A special category 3 gaming licence

The Act also provides for the investigation of suspected breaches and the prosecution of offences.

Compliance Mechanisms and Penalties:

Inspectors authorised under the Act have powers to monitor compliance with its provisions.

Breaches of the Act may result in the issuing of on the spot fines for minor infringements or, for more serious offences, suspension or cancellation of general licence, substantial fines and/or imprisonment.

Review or Appeal Mechanisms:

An appeal against a decision of the Chief Executive relating to a licence may be made to the Gaming Commission. Further appeals from a decision of the Gaming Commission on questions of law may be made to the District Court.
