Compliance Mechanisms and Penalties:
Inspectors appointed under the Act have the powers of entry, search and seizure of publications, or other evidence, after obtaining a warrant from a Magistrate or if directed by the Publications Classification Officer.
Offences against the Act may be prosecuted in Court.
A distributor who discovers that a prohibited publication has been distributed must take immediate steps to recall it.
Review or Appeal Mechanisms:
The Act provides for the adoption of publications classifications made by the Commonwealth Classification Board.
The Publications Classification Officer may classify publications which have not been previously classified and may also exempt publications or photographs of a medical, educational or scientific nature, or which are to be used for such purposes.
These decisions may be appealed to the Queensland Civil and Administrative Tribunal.
