Coastal Protection and Management Act 1995 - Queensland


The object of the Act is to provide for the protection, conservation, rehabilitation and management of Queensland's coast, including its resources and biological diversity, while allowing for ecologically sustainable development.

The Act provides for the development, implementation and review of statutory coastal management plans at a Statewide level. It also provides for the declaration of coastal management districts in which controls, rather than prohibitions, on development activities may be applied.

Development and other business activities within coastal management districts may be subject to the issue of coastal protection notices and tidal works notices which must be complied with.

Lodgement process


Authorised officers have powers to monitor and investigate compliance with the Act.

Prosecutions for offences are brought before a Magistrates Court. Proceedings may be brought in the Planning and Environment Court for an order to remedy or restrain an offence or threatened offence.

Fines are imposed for non compliance with an order, a coastal protection notice or tidal works notice, or for other offences against the Act.

A building or structure on unallocated State land may also be forfeited if the owner refuses to comply with a notice.

Review or Appeal Mechanisms:

An appeal against a coastal protection notice, tidal works notice or decision on a compensation claim may be made to the Planning and Environment Court.
