Description

To provide for the registration and regulation of cooperatives.

The Cooperatives Act 1997 contains provisions which will be consistent with other States and Territories' legislation.

The Cooperatives Act 1997 introduces cooperative principles and active membership requirements, enables cooperatives to have wider corporate powers, facilitates cooperatives engaging in inter state membership and cross border fundraising and trading, establishes an adequate enforcement regime and enhances directors' duties, facilitates and regulates take overs, mergers, transfer of engagements and reconstruction provisions. It allows for winding up and introduces requirements for disclosure to members when cooperatives are formed and when shares and debentures are issued.

Lodgement process

Comply

Following registration there may be lodgement and late lodgement fees payable. Penalties may be imposed on the cooperative and its officers by the court for breaches of the Act.

  • autonomy and independence
  • education, training and information
  • cooperation among cooperatives
  • concern for the community

Appeal process

Lodgement

An appeal may be made to QCAT against a refusal by the Registrar of Cooperatives:

  • to register a cooperative
  • to approve a draft disclosure statement of a proposed cooperative.
  • to approve the draft rules of a proposed cooperative.
