Description

Object or Purpose of this legislative Instrument:

To ensure the electrical safety of electrical contractors, electrical workers, other workers, consumers and the general public; and enhance consumer protection in relation to electrical work and the safe supply of electricity to customers.

Scope of this legislative Instrument:

The Regulation provides for the issue of licences and permits to electrical workers and contractors and sets out the criteria for applicants and the fees payable.

It also prescribes the requirements for the approved clearance and exclusion zones of electric lines and works and the performance of electrical work.

Electrical Worker includes an:

  • electrical fitter
  • electrical jointer
  • electrical linesperson
  • electrical mechanic
  • engineering tradesperson (electrical)
  • restricted electrical

The Regulator is the Director-General of the Department of Justice and Attorney-General (under the Electrical Safety Act 2002)

Compliance Mechanisms and Penalties:

The Department may take disciplinary action against a licence or permit holder where a breach of the legislation occurs. Penalties include a caution or reprimand, amendment, suspension or cancellation of licence or permit, and scheduled fines.

Fines may be imposed for other offences.

Review or Appeal Mechanisms:

An appeal against the Regulator's decision may be made to the Electrical Licensing Committee by lodging an application for review form.

An appeal against a decision by the Electrical Licensing Committee relating to a licence or to disciplinary action may be made to an Industrial Court.
