Emblems of Queensland Act 2005 - Queensland


To prescribe the floral and the faunal emblem of Queensland and to regulate the use of the badge and arms of the State of Queensland.

The Act applies to any person or organisation who intends to use or reproduce the badge or arms of Queensland. It prohibits the unauthorised use or assumption of the badge or arms.

Businesses who wish to use or reproduce the badge or arms, (e.g. in publications, etc), must obtain authority to do so.

The Act does not apply to the Crown or to persons acting on behalf of the Crown.

Compliance Mechanisms and Penalties

Permission to use or assume the badge, arms or emblems is granted at the discretion of the Minister.

Offences against this provision are liable to a fine and a person who continues to offend after conviction is liable to a fine for each day on which the offence is continued.

Prosecutions are conducted before the Magistrates Court.
