Fish movement exemption notice - Queensland

Description

Application for this notice is optional under the Fisheries Act 1994. It may be given for the need to provide fish passage at the waterway barrier works provided the Department  is satisfied that passage is not necessary or desirable for the best management, use, development or protection of fisheries resources or fish habitat.

If you decide to apply for a fish movement exemption notice, the notice must be obtained before the lodgment of a development permit application for operational works associated with construction or raising a waterway barrier works.

Eligibility requirements


There is no pre-requisite for obtaining a fish movement exemption notice.

You will need to provide the following at the lodgement of a development approval application:

  • completed fish movement exemption notice application
  • all fees including assessment fee
  • all necessary information required for the assessment of the application.

Duration

The fish movement exemption notice may be issued for a maximum duration of 4 years. If the proposed waterway barrier works is not taking place within that time period, applicants have to apply for a new fish movement exemption notice.

Application process

You must submit a completed fish movement exemption notice application form to a Fisheries office of the Department.

Applicants must include the necessary documents.

Further information/clarification of the proposal and mitigation options may be explored. Native title notification may be required.

Transfer

This permit cannot be transferred as it is issued to the land not to a person.
