Object or Purpose of this legislative Instrument:
The main purposes of this Act are:
- to provide for the protection of consumers of legal services and the public generally;
- to provide for the regulation of legal practice in this jurisdiction; and
- to facilitate the regulation of legal practice on a national basis.
Scope of this legislative Instrument:
This Act provides for the admission of lawyers, the issue and renewal of practising certificates, the complaints and disciplinary processes for lawyers, the regulation of interstate practitioners, the Legal Practitioners Fidelity Guarantee Fund, the making of conduct and other regulatory rules and professional indemnity insurance requirements.
The Act also provides new business structures for law practices (incorporated legal practices and multi disciplinary practices) and for the registration and regulation of foreign lawyers practising foreign law, although these parts of the Act have yet to be commenced.
