Resource / distribution operations licence - Queensland

Description

You will need this licence to operate existing or proposed infrastructure to distribute water. This licence allows you to interfere with water in order to operate the water infrastructure to which the licence applies. There are two categories of licence:

  • Resource operation licence - authorisation to interfere with the flow of water to the extent necessary to construct or operate water infrastructure and to take water to distribute it under the water allocations. This licence can only be held by the owner of the water infrastructure.
  • Distribution operation licence - authorisation to interfere with the flow of water to distribute water under the water allocations. This licence can be held by the owner of the water infrastructure or an entity nominated by the owner.

Eligibility requirements

To be eligible for a resource operations licence, you must be the owner of the water infrastructure within a water plan area.

To be eligible for the distribution operations licence, you must be the owner of the water infrastructure or an entity nominated by the owner. Nominees will not be approved unless they:

  • are a suitable entity to hold a licence
  • are capable to carry out the activities authorised by the licence
  • comply with the conditions of the licence.

Ongoing eligibility requirements

You may need to collect and report water monitoring information to comply with your licence. Application process

If you are named on the water plan, you may be granted the licence without the need to apply.

If the water infrastructure is not covered by a water plan you will need to apply in writing to the department, providing:

  • details of the existing or proposed infrastructure and arrangements for operating the infrastructure
  • details of the impact on flows of the existing or proposed infrastructure and arrangements for mitigation of the impact
  • the owner's written consent (if you are not the owner)
  • the prescribed fee.

Transfer

The holder of a resource operations licence or a distributions operations licence may apply in writing to the chief executive to transfer all or part of the licence to another entity.
