The Pest Management Act 2001 specifies the criteria for the issuing of licences to pest management technicians, the penalties for breaching the conditions of a licence and the appeal rights against refusal to grant, or suspension or cancellation of, a licence. The Pest Management Regulation 2003 is made under the Pest Management Act 2001.
The Pest Management Regulation 2003 provides minimum standards and licence forms for pest management technicians to ensure maintenance of environmental health standards and to reduce the risk of exposure to pesticides and fumigants by licensees, occupiers of treated premises and the general public.
The Regulation sets out standards for minimum storage requirements of pesticides and fumigants, both in buildings and vehicles, to:
restrict the access of pesticides and fumigants to persons who are licensees or competent and responsible to have the charge of pesticides or fumigants.
minimise the risk to public health, animal health and the environment in the event of any breakage of container or leakage of pesticides or fumigants.
provide immediate identification of the pesticide or fumigant and pest management technician in the event of an accident.
provide for the safe disposal of empty pesticide and fumigant containers.
provide for the disposal of pesticides and fumigants so as not to endanger the lives or safety of humans, domestic animals or to pollute water supplies.
The Pest Management Regulation 2003 also prescribes the fees for application for, or renewal of, a Pest Management Technicians licence and the penalties for breaches of the Regulation.
Your pest management technician's licence may be suspended or cancelled and fines may be imposed for breaches of the Pest Management Regulation 2003.
