Object or Purpose of this legislative Instrument:

To ensure that the printers and publishers of documents and newspapers to be sold or distributed to the public are identified.

Scope of this legislative Instrument:

The Act requires a printer of certain printed documents, which he/she knows, or has reason to believe, are intended to be sold or distributed, to print his/her name, business address and the year in which the document was printed on the first or last page of the document.

The Act also requires the printer of a newspaper to print, on the first or last page of the newspaper, his/her name and place of business and the name and address of the publisher of the newspaper.

The requirement for a printer to print the year of publication on a document will assist persons wishing to obtain current publications, such as street directories and road maps.

Certain documents are exempted from the provisions of the Act, such as the document printed for the Crown in right of the State or of the Commonwealth, other Government documents, financial documents e.g bills of exchange and documents containing information relating to proposed sales of property.

Compliance Mechanisms and Penalties:

The Act gives Queensland police officers the power to request a copy of a document or newspaper.

All offences under the Act may be prosecuted through the courts on the complaint of a police officer or other authorised person. Fines may be imposed by the court.

An appeal against a court decision may be made in accordance with the relevant court rules.
