Public Health Act 2005 - Queensland


The objective of the Public Health Act 2005 is to protect and promote the health of the Queensland Public.

The Public Health Act 2005 consolidates and amends the laws relating to public health in Queensland. The Act prescribes the power and responsibilities of State and local Government, the Chief Health Officer and other authorized persons. The Act further prescribes the procedures to be followed in the prevention, notification and treatment of notifiable diseases and the responsibilities of medical practitioners and private hospitals in the area. It also provides for the identification and regulation of public health risks.

Compliance Mechanisms and Penalties:

The Chief Executive Officer may appoint environmental health officers and other authorized officers (including police officers) to enforce compliance with the Act. These officers have powers to enter and search premises (including vehicles), seize evidence relating to offences and serve notices.

Offences may be prosecuted in court and can result in fines. Cancellation or suspension of licences may also result.
