A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Exemptions

You may not need approval if your swimming pool or spa is located on private property, such as:

  • pools or spas associated with hotels and motels
  • pools or spas associated with private schools
  • residential pools or spas.

Eligibility requirements

You may also require development approval if you are conducting the following activities:

  • starting a new commercial swimming pool
  • changing the type of activity (e.g. from private pool to commercial pool)
  • re-establishing a swimming pool that has been abandoned
  • changing the scale of activity (e.g. adding a new pool)
  • carrying out building work
  • carrying out plumbing or drainage work.

You may also need plumbing and drainage approval if you are conducting the following activities:

  • release of trade waste to sewer
  • installation and maintenance of backflow prevention devices
  • use of non-reticulated water supply (tank water).

If you intend to empty the pool, you must notify your local council at least 24 hours beforehand. You must comply with any directions given about when and how the public pool is to be emptied.

To apply for a public pool approval, you must:

  • complete the approval application form
  • pay the prescribed fee.

Additional information

A public pool approval may be granted with additional conditions, which may include:

  • the operator is to test the water daily to ensure that biological contaminants are kept within levels specified in Australian Standards
  • provision of equipment for emergency medical treatment and first aid or rescue of persons in difficulty or other aspects of public health and safety
  • display of notices providing information about basic lifesaving resuscitation and first aid techniques or warning about possible dangers
  • installation of special equipment for filtering, purifying, and recirculating the water
  • provision of dressing rooms and facilities for showering and sanitation.
