Temporary food stall licence (Brisbane) - Queensland


Please note: Incomplete or incorrect applications may be rejected by Brisbane City Council.

A food business that conducts the following activities requires a licence from council: NB: If you are unsure if your business requires a licence, contact council.

Sale of unpackaged food by retail. Examples:

  • BBQ stall/sausage sizzle at outdoor event,
  • food stalls at markets.

You can apply for either a one-off Temporary food stall licence (1-4 or 5-12 consecutive days) or an annual licence (covering a single location for weekends and public holidays only, e.g. stalls at weekend markets).

You do not need a Temporary food stall licence for the following:

  • selling or serving tea or coffee;
  • selling only prepackaged known brand names of food and drink that have been packaged by a licensed manufacturer or packager. Examples: soft drinks in cans or bottles, packaged crisps, packaged cakes, packaged sauces;
  • taste testing food prepackaged by a licensed manufacturer or packager without changing the state of the food through cooking, blending or processing. Examples: crisps, sauces, baked goods, lollies, oils, drinks, cheese;
  • fruit and vegetables sold whole or cut up for taste testing or garnishing only;
  • primary producers selling unpackaged meat, seafood, dairy or poultry directly from a transport vehicle registered with Safe Food Production Queensland.

People working on the stall must have access to adequate toilet and hand washing facilities.

Eligibility requirements

If you are a religious or charitable organisation and are eligible for a fee discount or exemption for this application, you need to lodge the application in person or by mail. Attach the required documentation proving your eligibility to receive the discount or exemption (contact Brisbane City Council for more information).


Annual licence issued for one year can be renewed annually. One-off licence issued for 1-4 or 5-12 days as specified on your application, not renewable. Renew your annual licence (you will receive a renewal notice in the mail) online, by phone, or in person at any Brisbane City Council regional business centre.

Application process

Complete the Temporary food stall licence application form and submit it to council by mail or in person with the correct fees.

  • you must submit the application at least 10 working days before you wish to start operating your stall
  • amendments must be lodged by mail or in person at your nearest council regional business centre
  • council may inspect the stall during its operation.

If you are an agent for the proposed licence holder, e.g. solicitor or consultant, and you are lodging the application on their behalf, you must provide proof of your authorisation. An Agent authorisation form is supplied for this purpose.

You must supply all mandatory information and documentation when making an application. If your application is substantially incomplete, or incorrect, Brisbane City Council will not be able to process the application. Council will not refund fees in this case. You may need to pay a resubmission fee if you resubmit an application that has previously been refused for this reason.

If serving or selling alcohol, you will need a Liquor Licence from the Office of Liquor and Gaming Regulation. You can obtain this after applying for the Temporary food stall licence.

This licence cannot be transferred.
