Object or Purpose of this legislative Instrument:

This chapter of the Transport Infrastructure Act establishes a mechanism to control and monitor port activities and ensure the safe, secure and efficient operation of ports and the protection of the environment at the port area.

Scope of this legislative Instrument:

This chapter of the Act sets out the powers, functions and responsibilities of port authorities and port lessors including land management and port activities, including business activities and the powers to impose charges for the use of the port.

The chapter provides for the issue of notices by a port authority or port lessor to control activities and conduct at the port and sets outs the powers of authorised officers appointed by a port authority or port lessor.

It also provides for the issue of approvals for controlled activities in a port, controlled activities area to operate tug services or fuelling facilities or to burn, rivet, weld, spray paint, or sand blast on a ship.

Appeal process


Compliance Mechanisms and Penalties:

Fines may be imposed for non compliance with a port notice, direction by an authorised officer and other offences against the legislation.

Breaches of the conditions of an approval granted by a port authority can result in fines, cancellation of approval or changes to its conditions.

Review or Appeal Mechanisms:

A person may request an internal review against a decision by a port authority to refuse, revoke or amend the conditions of an approval relating to a controlled activity. If the internal review is unsuccessful, the person may appeal to QCAT.
