Authority to build infrastructure and structures (including service facilities) in protected areas - Queensland

Description

The building of infrastructure and structures (including service facilities) in protected areas must be managed according to the requirements of sections 15 and 34(2) of the Nature Conservation Act 1992.

Examples of use 
Interest in land use of a protected area is most commonly for infrastructure such as:

  • transmission lines
  • communication towers, and
  • pipelines.

If a management statement or management plan is in effect for a protected area, the statement or plan has to be considered as well.

However, section 35 of the Act makes it possible for the chief executive of the department to allow a proposed use of a national park or protected area that is inconsistent with the management principles or management plan, if:

  • the basic principle for the management of national parks will be observed as far as possible (if the land is in a national park)
  • the use will be in the public interest
  • the use is ecologically sustainable
  • there is no reasonable alternative to the use.
