The Act outlines the requirements for disposing of a body by cremation and imposes record keeping obligations in relation to cremations.
The Act provides that before a body is disposed of by cremation, permission to cremate must be obtained by a doctor (who cannot be the doctor who issues the cause of death certificate) or a coroner (if the death is a reportable death under the Coroners Act 2003). The Act outlines who may apply for permission to cremate and provides that a coroner or independent doctor may not issue the permission if they are aware that the deceased close family or personal representative object to the cremation. The Act and Regulations also impose record keeping obligations on coroners, doctors who issue permission to cremate and on crematorium operators.
