Field agent licence - Queensland

Description

You must have a valid licence to work as a field agent.  A field agent is licensed to:

  1. find and recover goods (repossession)
  2. collect debts face-to-face
  3. serve documents (preocess serving)

Alternatively, you can work as a collection agent if you only:

  • collect debts (and do not repossess goods or do process serving)
  • contact debtors over the phone or in writing.

You must have a licence (or in some cases a subagent registration) to do any other type of work as a debt collector or process server.

In  most cases, a corporation that works in the debt collection industry must have a corporate licence.

Authorised activities

A corporate field agent licence allows a company's business to involve:

  • finding and recovering goods
  • collecting debts
  • serving documents to debtors.

For most debt collection work, you must have a corporate licence as a field agent.

An exception applies if you only:

  • collect debts (and do not repossess goods or do process serving)
  • contact debtors over the phone and in writing.

In these cases, your company will be a collection agent and you will need to comply with certain rules.

Eligibility requirements


You must:

  • be at least 18 years of age
  • be a suitable person
  • be an eligible person

Note: If you are notifying under the Mutual Recognition (Queensland) Act 1992 or the Trans Tasman Mutual Recognition (Queensland) Act 2003, you must be authorised to practise an occupation equivalent to the Queensland occupation covered by this licence in a participating State or Territory or in New Zealand.

Duration

This licence will remain in effect for 12 months or 3 years. You will be issued with a renewal notice annually or every 3 years approximately 6 weeks before the expiry date.

Application process

Submit a "Form 1-1: Application for individual's licence" or "Form 1-2: Application for Corporation's Licence".

Your application must be accompanied by:

  • an application fee
  • a licence issue fee
  • a criminal history check fee for each person whose date and place of birth appear on the application
  • a certified copy of either your birth certificate, birth certificate extract, passport, Certificate of Australian citizenship or drivers licence. Proof of identity can be certified by a Justice of the Peace, Commissioner for Declarations, barrister/solicitor or notary public. (note: none of the above required to be provided upon renewal on the proviso that the name the licence was issued in has not changed or unless otherwise requested)
  • 2 recent colour photographs. Each photograph must be at least 35 mm x 45 mm and not more than 40 mm x 50 mm in size, and certified by a person who- is at least 18 years of age; and has known you for not less than 12 months immediately before the application; and Is not related to you by birth or marriage
  • evidence of eligibility to hold the licence.

The licence application fee and licence renewal application fee are not refundable.

For each location a company has for each PAMDA licence, there must always be an individual full licence holder based on the premises.

If you are notifying under the Mutual Recognition (Queensland) Act 1992 or the Trans-Tasman Mutual Recognition (Queensland) Act 2003 submit an "Application for Mutual Recognition of occupational licence" Mutual Recognition Form 1 and a copy of your current interstate licence.

*If you are applying for an additional licence under the Property Occupations Act 2014 or the Motor Dealers Chattel Auctioneers Act 2014 you only need to pay an application fee for each additional licence class.

Transfer

You cannot transfer this licence to another entity.

Additional information

There are no educational requirements for applicants for a field agent.

Applicants must undergo a criminal history check to confirm their suitability. The criminal history check applies to each person for whom a date and place of birth are requested on the application form. The fee applies to all applications and renewal notices.
