Health Act 1937 - Queensland

Description

The purpose of the Health Act 1937 is to preserve and enhance the standards of public health in Queensland and to protect the public interest in terms of public health.

Under the Health Act 1937 provision is made for the issue of licenses to, and the regulation of, manufacturers, wholesalers, and sellers of drugs and poisons. It also provides for the labeling of drugs and poisons

Compliance Mechanisms and Penalties:

The Chief Executive Officer may appoint environmental health officers and other authorised officers (including police officers) to enforce compliance with the Act. These officers have powers to enter and search premises (including vehicles), seize evidence relating to offences and serve notices.

Offences may be prosecuted in court and can result in fines. Cancellation or suspension of licences may also result.

Review or Appeal Mechanisms:

Licencees of scheduled drugs and poisons may appeal to a Magistrate's Court against a decision by the Chief Executive Officer to refuse, suspend or cancel a licence.
