Positive Notice Card for staff and volunteers of funded non-government service providers - Queensland

Description

It is a requirement under the Disability Services Act 2006 (Qld) for all people engaged by a Department of Communities, Child Safety and Disability Services (the Department) funded non-government service provider or a National Disability Insurance Scheme (NDIS) service provider at a service outlet to undergo criminal history screening.  The obligation is on the service provider to identify all people who fit the definition of an 'engaged person' and submit an 'Application for criminal history screening - prescribed notice (yellow card)' or 'Application for criminal history screening (exemption notice)' on behalf of each engaged person.
The service provider is also responsible for seeking the person?s consent to conduct a criminal history check.

Engaged staff who may require an application to be completed include:

  • employees
  • volunteers
  • students
  • contractors
  • executive officers, members of a board, management committee or other governing body

Criminal history screening is not required for:

  • consumers
  • tradespeople who are not employees
  • relatives of a consumer providing volunteer care for their relative.

Applications must be on the approved forms, signed by a representative of the service provider and the engaged person and accompanied by the prescribed fee.

Duration

A Positive Notice Card is valid for 3 years after issuing. Criminal history screening will be conducted on each individual who continues to be engaged by a service provider every three years.

Application process

This Positive Notice Card can be obtained by the service provider submitting an "Application for Criminal History Screening (prescribed notice)" on behalf of the engaged person to the Department either by mail, or electronically to criminalhistoryscreening@disability.qld.gov.au.

Transfer

A Positive Notice Card cannot be transferred to another person. However, it can be used for engagement with multiple service providers during its validity

Additional information

The Department will forward the application to the Queensland Police Service for a national check of the person's criminal history.

The Department will use the information to determine whether or not a person should be engaged by a service provider. In the situation where the person has a criminal history, a decision to issue either a Positive Notice or Negative Notice will be made by the Director-General.

If the decision has been made by the Director-General to issue a Positive Notice, the applicant will be issued with a Positive Notice Card and an accompanying Positive Notice letter. The official contact person within the service provider will also receive a letter notifying them of the issuing of a Positive Notice.

If the decision has been made by the Director-General to issue a Negative Notice, the applicant will be sent a letter notifying them of the decision and the reasons for the decision. The official contact person within the service provider will also receive a letter notifying them of the issuing of a Negative Notice.
