Temporary Food Stall Licence - Queensland

Description

A food business that conducts the following activities requires a licence from Council:

Sale of unpackaged food by retail, examples:

  • bbq stall/sausage sizzle at outdoor event,
  • food stalls at markets.

Non profit organisations are considered licensable food businesses if they provide meals at a particular place on at least 12 days each financial year, examples:

  • a restaurant, open daily to the public operated by a sporting club to raise revenue for the club,
  • a non-profit organisation preparing and selling meals to homeless persons at a homeless person hostel the preparation of meals by Meals on Wheels,
  • mobile food van (providing meals) at a sporting ground.

If you operate your licensable food business from temporary premises (e.g. stalls, fetes or markets etc) in more than one local council area, you are required to hold a food business licence with each of the local councils where you intend to operate.

You do NOT need a Temporary Food Stall Licence for the following:

  • selling or serving tea or coffee,
  • selling only prepackaged known brand names of food and drink that have been packaged by a licensed manufacturer or packager. Examples: soft drinks in cans or bottles, packaged crisps, packaged cakes, packaged sauces,
  • taste testing food prepackaged by a licensed manufacturer or packager without changing the state of the food through cooking, blending or processing. Examples: crisps, sauces, baked goods, lollies, oils, drinks, cheese,
  • fruit and vegetables sold whole or cut up for taste testing or garnishing only,
  • primary producers - selling unpackaged meat, seafood, dairy or poultry directly from a transport vehicle registered with Safe Food Production Queensland.

People working on the stall must have access to adequate toilet and hand washing facilities. Council may conduct an inspection during the term of the licence.
