This requirement applies to buildings in which essential safety provisions are installed or required to be installed, or to be inspected, tested or maintained under the "Building Rules".
It does not apply to Class 1a - Habitable Dwellings than associated Class 10a out buildings.
A relevant authority or Council must issue a schedule in the appropriate form (Form 1, Schedule 16 of Development Regulations 2008), specifying the essential safety provisions relating to that building and the standards or other relevant requirements for each of the relevant essential safety provisions set out in Ministers Specification SA 76 on:
- granting building rules consent;
- assignment of a change of classification;
- application by the owner of a building; or
- issue of any other classification to a building requiring essential safety provisions
The owner of such building must, within a reasonable time after installation of such provisions, provide Council with Certificate of Compliance for each of the required items, on the appropraite form under Schedule 16, signed by the installer or the Manager of the company responsible for the installation.
The owner must not permit the use of a building to the above appliances unless such maintenance and testing have been carved out.
The owner of a building referred to above must, as soon as practical after each calendar year, provide to Council adequate proof that such maintenance and testing have been carried out.
