Land Agents Registration - Individual/Partnership - South Australia


This registration is required by persons who are selling, purchasing, or otherwise dealing with land or businesses, on behalf of others; conducting negotiations for the sale or purchase of land or businesses on behalf of others; selling land or businesses on their own behalf; or conducting negotiations for the sale of land or businesses on their own behalf.

You are not considered to be carrying on a business as a land agent if you are: in the course of practice as a legal practitioner, selling, purchasing, or dealing with land or businesses (including conducting negotiations for that purpose) on behalf of others; selling land or businesses or conducting negotiations for that purpose, through the instrumentality of an agent; or solely engaged in mortgage financing.

Eligibility requirements

Applicants must have approved educational qualifications. A full list of acceptable qualifications including specific subjects which need to have been completed are contained within the registration application form.

In addition to holding these qualifications you are entitled to be registered if you: have not been convicted of an indictable offence of dishonesty or in the last ten years preceding the application not been convicted of a summary offence of dishonesty; are not suspended or disqualified from practising a trade, occupation or business in Australia; are not an undischarged bankrupt or subject to a composition or deed or scheme of arrangement with or for the benefit of creditors; and have not been in the last 5 years preceding the application for registration, a director of a body corporate wound up for the benefit of creditors - when the body corporate was being so wound up or within the period of 6 months preceding the commencement of the winding up.

In a partnership, all partners need to be individually registered.
