A Wholesale Liquor Merchant's Licence is required sell liquor to:
- a liquor merchant at any time for consumption off the licensed premises;
- between certain hours to a person other than a liquor merchant for consumption off the licensed premises;
- to sell or supply liquor by way of sample for consumption on the licensed premises; or
- to sell liquor at any time through direct sales transactions (provided that, if the liquor is to be delivered to an address in this State and the purchaser of liquor is not a liquor merchant, the liquor is despatched and delivered only between 08:00 and 21:00 hours, and not Good Friday or Christmas Day).
A Wholesale Liquor Merchant's Licence is subject to several conditions concerning the aggregate quantity sold to a purchaser, and the relative turnover derived from the sale of liquor in each assessment period to liquor merchants.
The Licensing Authority must be satisfied that the proposed premises are suitable, have all the necessary planning and building approvals, applicants are suitable, that the granting of the licence will not cause any undue offence or annoyance to those who work, worship or reside in the locality, and that the licence category is suitable for the activity proposed. The licensing authority may refuse an application for a licence, but instead may grant a certificate of approval for the proposed premises.
