Applicants for a building work contractors licence must meet the relevant performance criteria contained within Schedule 2 of the Building Work Contractors Regulations 1996.
In addition to meeting this criteria they must be a fit and proper person, must not have been suspended or disqualified from practising a trade, occupation or business in Australia; an undischarged bankrupt within the 10 years preceding the application for a licence or be subject to a composition or deed or scheme of arrangement with or for the benefit of creditors; within 10 years before the making of an application for a licence, a director of a body corporate which has been wound up for the benefit of creditors - at the time of the body corporate being wound up or within a period of 12 months preceding the commencement of the winding up.
Applicants must be able to demonstrate possession of sufficient financial resources and have sufficient business knowledge and experience. Where a building work supervisor is being employed, the contractor must seek the approval of the Commissioner for that building work supervisor to be engaged.
In a partnership, all partners need to be individually licensed.
