Licence to Operate a Major Hazard Facility - Tasmania

Description

You will require this licence if you intend to operate a major hazard facility. A major hazard facility is either:

  • a facility at which chemicals prescribed by Schedule 15 of the Work Health and Safety Regulations are present in quantities greater than designated threshold quantities
  • a facility at which chemicals prescribed by Schedule 15 of the Work Health and Safety Regulations are present in quantities greater than 10 percent of designated threshold quantities, and at which the regulator considers there to be the potential for a major incident, such as an escape, spillage, leakage, explosion, implosion or fire, to occur.

Schedule 15 chemicals include a variety of:

  • explosive materials
  • compressed and liquefied gases
  • flammable materials
  • oxidising materials
  • peroxides
  • toxic solids and liquids.

You will not require this licence to operate a facility which is regulated by the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA), or a pipeline or distribution system which is licensed under Tasmanian gas legislation.

Eligibility requirements

To be eligible for this licence you must:

  • be the operator of a determined major hazard facility
  • be deemed a suitable person to operate a major hazard facility
  • provide proof of your identity
  • submit a safety case report in accordance with the regulations
  • provide access to all of the installation to allow for auditing and verification of the objectives and standards as stated in the safety case
  • complete the relevant application form
  • pay the prescribed fee
  • supply any additional information as required by the Agency.

You may apply for an exemption from this licensing requirement if you believe you have sufficient cause. An exemption may be granted on the Agency's own initiative or on the written application of the applicant.
