Approval to Use Supervised Treatment - Victoria

Description

You may require this approval if you are a disability service provider and intend to provide services to intellectually disabled persons. A disability service is a service that is provided specifically for the support of persons with a disability.

A supervised treatment order is a civil order that can only be made by the Victorian Civil and Administrative Tribunal (VCAT) authorising the use of compulsory treatment on a particular person. It specifies conditions that apply to the person, and may require the person to participate in treatment specified in a treatment plan.

Eligibility requirements

To be eligible for this approval you must:

  • be a registered disability service provider
  • nominate a person or persons to be appointed as an Authorised Program Officer
  • submit the forms or documentation required by the Agency.

You may only apply to VCAT for an authorised treatment order if:

  • the person has an intellectual disability
  • the person is receiving residential services from you
  • you have an approved treatment plan in place for the person
  • the person has exhibited a pattern of violent or dangerous behaviour causing serious harm to another person (or exposing another person to a significant risk of serious harm)
  • the person poses a significant risk of serious harm to another person which cannot be substantially reduced by less restrictive means.

You will also be required to notify the person and the Public Advocate.

It is ordinarily illegal to detain an intellectually disabled person and provide them with medical treatment against their will (compulsory treatment).
This approval allows you to appoint one or more authorised program officer. Only an authorised program officer may apply to VCAT for a supervised treatment order.
VCAT will only grant a supervised treatment order if it satisfied of certain criteria, including that the person poses a significant risk of serious harm to another person which cannot be substantially reduced by less restrictive means.
