Legal Practising Certificate - Western Australia

Description

You may require this certificate if you intend to engage in legal practice in Western Australia. Legal practice means being paid to do any work in connection with the administration of the law, including preparing deeds, instruments or contracts relating to legal proceedings of any kind.

You will not require this certificate to undertake the following kinds of legal practice:

  • the practice of foreign law by an Australian-registered foreign lawyer
  • drawing or preparing a transfer of land
  • legal work in the course of the duties of a public officer
  • legal work under the supervision of an Australian legal practitioner, as a paid employee of a law practice or in the course of approved legal training.

Please note that separate application requirements apply to local applicants, interstate practitioners, New Zealand practitioners, and practitioners from overseas. If you intend to practice law as a corporation, you must apply for a notice of intention to provide legal services.

Please note that if you have a valid practising certificate from a different Australian jurisdiction that authorises you to practice as a lawyer everywhere in Australia, you do not need to apply for a separate Western Australian certificate.

Eligibility requirements

To be eligible for this certificate you must:

  • hold a Bachelor of Laws or Juris Doctor degree from a recognised university
  • complete an approved practical legal training course
  • have been admitted to practice by an Australian Supreme Court.

If you were admitted in another jurisdiction you may also need to provide the following documents:

  • certified copy of your admission certificate
  • statutory declaration detailing your previous employment history in legal practice
  • Certificate of Good Standing from the appropriate regulatory authority in the State or Territory where you were admitted / held a practising certificate.

Different requirements apply if you were not admitted to practice in Australia or New Zealand.
